Irving Sheppard, a California state prisoner, appeals pro se the district courts order dismissing his petition for a writ of habeas corpus. He claims that (1) he failed to receive adequate notice that he would face a charge of felony-murder; (2) the trial court erred in admitting evidence of a nine-year-old conviction for robbery; and (3) he was denied effective assistance of counsel on direct appeal. We find that petitioner failed to receive adequate notice to enable him to prepare a proper defense to the charge of felony-murder, and on that ground alone reverse the district court and order that the writ of habeas corpus be issued.
