OPINION ¶1 Appellant, Ricky Leon Jackson, hereinafter referred to as defendant, was charged, tried, and convicted in the District Court of Oklahoma County, Case No. CRF-72-197, for the crime of Attempted Robbery With Firearms, After Former Conviction of a Felony. He was sentenced to serve a term of forty-five (45) years in the State Penitentiary in accordance with the verdict of the jury, and a timely appeal has been perfected to this Court.
